Lawsuit filed against Sewer District

SEELEY LAKE - Sewer district landowner and resident Don Larson filed a complaint and request for an injunction with the Montana Fourth Judicial District Court against the Seeley Lake Sewer District and Missoula County. The requested injunction would prevent the district from moving forward with the proposed sewer project.

In the documents filed with the court, Larson makes several allegations including mishandling the protest process and protest letters, failing to provide reliable financial information about the project including estimates for future phases, disenfranchising renters, failing to answer questions from the public, violating campaign ethics and the sewer board making decisions when the board was confused and lacked understanding.

Based on these allegations, Larson is asking for the court to order the district to stop taking any actions toward construction of the sewer, not to incur debt nor collect assessments and that Missoula County stop providing the district any resources including in-kind services. It also requests that the notice and protest the district conducted in the fall of 2017 be nullified and declared void.

The Pathfinder reached out to the Missoula County Commissioners and Seeley Lake Sewer District Board President Mike Boltz for comment with an email. Commissioner Jean Curtiss wrote July 26 that it was too early to make comment as the county had not been served with the lawsuit. Boltz did not reply to the email requesting comment.

Larson also filed for a preliminary injunction that would stop the district from taking any action pending the outcome of the lawsuit. Judge Karen S. Townsend set the hearing on the preliminary injunction for Aug. 7 at 3 p.m. at the Missoula County Courthouse, 200 West Broadway.
